This Acceptable Use Policy ("AUP") is part of your Agreement with Soni Digital LLC ("Company," "we," "us," or "our") and applies to your use of the PickWho mobile application and all related services (the "Service"). Capitalized terms not defined in this AUP have the meanings given to them in the PickWho Terms of Service.
You agree to use the Service only for the purposes intended as permitted by the Agreement, including the Terms of Service, this AUP, and applicable laws and regulations. By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account, disqualification from Prizes, and any other remedies available to the Company under the Agreement or applicable law.
PickWho is a free sports prediction game for entertainment purposes only. You never deposit money, place wagers, or risk any financial loss when using the Service. There are no odds, point spreads, or parlays. You simply predict which team you believe will win a given sporting event.
You agree not to use or characterize the Service as a gambling, betting, or wagering platform. The Service is not designed or intended to facilitate gambling of any kind, and you must not use it for such purposes.
Each contest period, the Service will display upcoming professional sporting events. You may select the team you predict will win before the applicable game begins. Once a game starts, your prediction for that game is locked and cannot be changed.
You agree to submit all predictions manually and in good faith. Predictions must reflect your own independent judgment.
Each weekly contest may have a Prize. The User with the most correct predictions at the end of the contest period wins. Tiebreakers are applied if needed. Prize eligibility, value, and distribution are at the sole discretion of the Company.
You agree not to engage in any conduct designed to unfairly influence Prize outcomes, including manipulating predictions, colluding with other Users, or exploiting technical errors.
PickWho is completely free to use. You can make unlimited predictions and compete in all contests at no cost. The Service is supported by advertisements displayed when free Users save their picks.
We offer an optional premium subscription (PickWho Premium) that removes advertisements. PickWho Premium does not provide any advantage in contest participation, prediction mechanics, or Prize eligibility. Purchasing PickWho Premium is entirely optional and does not affect your ability to use the core Service.
Each User may maintain only one (1) account. Creating, maintaining, or using multiple accounts is strictly prohibited. If we determine that you are operating more than one account, all of your accounts may be terminated and you will be disqualified from any pending or future Prizes.
You agree that any information you provide during registration or in connection with your use of the Service will be accurate, correct, and up to date. You are responsible for maintaining the confidentiality of any login credentials associated with your account and for all activities that occur under your account.
You may delete your account at any time through Settings > Delete Account in the app. Account deletion is permanent and removes all of your data, including predictions, statistics, and leaderboard history. The Company is not obligated to restore any data following account deletion.
The integrity of PickWho contests depends on every User participating honestly. You agree to the following fair play rules:
PickWho includes features that allow Users to view leaderboard rankings, compete against one another, and communicate via the community chat. When engaging with the Service in any manner that involves other Users, you agree not to:
The community chat is provided for casual conversation among Users. Messages are automatically filtered for inappropriate content, and our moderation team reviews all reports within 24 hours. Users who violate these rules may be muted, banned from chat, or have their accounts terminated.
You can report inappropriate messages directly in the chat and block Users whose content you do not wish to see. Blocking a User immediately hides their messages from your view and notifies our moderation team.
Chat messages are visible to all Users and app administrators. Do not share personal or sensitive information in the chat. You can delete your own messages at any time.
The Service is intended for personal, non-commercial entertainment use. You may not use the Service, or any data or content obtained from the Service, for any commercial purpose. This includes, without limitation, using the Service to advertise, promote, or market any product, service, or business without consent.
You acknowledge that all content, features, and functionality of the Service (including text, graphics, logos, icons, images, software, and data) are owned by the Company or its licensors and are protected by intellectual property laws.
If you believe that any content on the Service infringes your copyright or other intellectual property rights, you may notify us in writing at info@pickwhoisfree.com. Your notice should include: (i) a description of the copyrighted work or intellectual property you believe has been infringed; (ii) a description of where the allegedly infringing material is located within the Service; (iii) your contact information; (iv) a statement that you have a good-faith belief that the use is not authorized; and (v) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act on the owner's behalf.
We have the right, at our sole discretion, to investigate and take action against any violation of this AUP. Enforcement actions may include, without limitation:
We are not required to provide notice before taking enforcement action, although we may choose to do so. We are not obligated to monitor the Service for violations of this AUP, but we reserve the right to do so.
If you believe that another User is violating this AUP, please report it to us at info@pickwhoisfree.com. We will review all reports and take such action as we deem appropriate in our sole discretion. We are not obligated to disclose the outcome of any investigation or enforcement action.
We reserve the right to update this AUP at any time. If we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of the Service after any changes constitutes your acceptance of the revised AUP.
